General Promotions Terms & Conditions
These general terms and conditions ("General Conditions") apply to all promotions, offers, discounts, referral schemes, trial periods, and incentives ("Promotions") offered by ARC Club ("we", "us", "our") via our website at www.arc-club.com, in-club, by email, or through any other channel. Each individual Promotion will be subject to its own specific terms and conditions in addition to these General Conditions. In the event of any conflict between these General Conditions and the specific terms of an individual Promotion, the specific terms shall take precedence.
By participating in any Promotion, you confirm that you have read, understood, and agree to be bound by these General Conditions and any applicable specific terms.
1. Eligibility
1.1 Unless the specific terms of a Promotion state otherwise, Promotions are open to individuals aged 18 or over who are residents of the United Kingdom.
1.2 Promotions are not open to employees, contractors, agents, or representatives of ARC Club, or members of their immediate families, unless expressly stated.
1.3 We reserve the right to verify the eligibility of any participant and to disqualify any individual who does not meet the eligibility criteria or who we reasonably suspect has obtained a benefit fraudulently, by misrepresentation, or in breach of these General Conditions.
1.4 Some Promotions may be limited to specific membership tiers, new customers, existing members, or other defined groups. Please refer to the specific terms of each Promotion for full eligibility details.
2. How to Participate
2.1 The method of entry or redemption for each Promotion will be set out in its specific terms. This may include, but is not limited to, entering a promotional code at checkout, clicking a link in a marketing email, presenting a valid offer in-club, or signing up via our website.
2.2 Incomplete, illegible, or fraudulent entries or redemption attempts will be void.
2.3 Unless stated otherwise, only one Promotion may be claimed per person, per household, or per membership account at any one time. Promotions cannot be combined with other offers unless expressly permitted.
3. Promotional Codes
3.1 Where a Promotion includes a unique or generic promotional code, the code must be applied at the time of purchase or sign-up. We are unable to apply codes retrospectively once a transaction has been completed.
3.2 Promotional codes are non-transferable and have no cash value. They may not be sold, exchanged, or reproduced.
3.3 Codes are subject to availability and may be withdrawn or changed at any time without notice. Codes that are shared publicly without our authorisation may be cancelled.
3.4 Where a code is issued to a named individual or account, it may only be used by that person.
4. Validity Periods
4.1 All Promotions are valid only during the period specified in their individual terms. Promotions cannot be redeemed outside of their stated validity window.
4.2 We are not responsible for any failure to redeem a Promotion before its expiry date.
4.3 We reserve the right to extend, shorten, or withdraw any Promotion at any time and without prior notice, provided that any such change will not affect the rights of participants who have already validly redeemed the offer.
5. Discounts, Credits & Offers
5.1 Discounts and credits apply only to the specific products, services, or membership types stated in the individual Promotion terms. They do not apply automatically across all ARC Club products and services.
5.2 Unless otherwise stated, discounts apply to the standard listed price at the time of redemption and may not apply to already-discounted or promotional rates.
5.3 Credits issued as part of a Promotion are non-refundable, non-transferable, and cannot be exchanged for cash. Any unused credits will expire at the end of the period stated in the specific Promotion terms.
5.4 ARC Club reserves the right to limit the total value of any discount, credit, or benefit available under a Promotion.
6. Referrals
6.1 Where a Promotion involves the referral of a third party, both the referrer and the referee may be required to meet eligibility conditions set out in the specific terms.
6.2 Self-referrals, or referrals made using false or duplicate accounts, are strictly prohibited and will result in disqualification and potential suspension of membership.
6.3 Referral rewards will only be issued once all qualifying conditions have been satisfied and verified by us.
7. Amendments & Withdrawal
7.1 We reserve the right to amend these General Conditions and the specific terms of any Promotion at any time. Any changes will be communicated via our website and will apply from the date of publication.
7.2 We reserve the right to withdraw, suspend, or discontinue any Promotion at any time for reasons including, but not limited to, fraud, error, technical failure, or circumstances beyond our reasonable control.
7.3 In the event a Promotion is withdrawn before you have had an opportunity to redeem it, our liability is limited to the face value of the benefit you would have received.
8. Fraud & Misuse
8.1 Any attempt to obtain a Promotional benefit through fraudulent means, including the use of fake accounts, automated tools, or the exploitation of technical errors, will result in immediate disqualification and may be reported to the relevant authorities.
8.2 We reserve the right to recover the value of any benefit improperly obtained
9. Liability
9.1 To the fullest extent permitted by applicable law, ARC Club accepts no liability for any loss, damage, or disappointment suffered as a result of participating in or being unable to participate in any Promotion, including as a result of technical failures, interruptions, or errors.
9.2 Nothing in these General Conditions limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded by law.
10. Data & Privacy
10.1 Personal data collected in connection with any Promotion will be processed in accordance with our Privacy Policy, available at www.arc-club.com/privacy. We will not use your data for marketing purposes without your consent.
11. Governing Law
11.1 These General Conditions and any dispute arising in connection with any Promotion shall be governed by and construed in accordance with the laws of England and Wales. You agree to submit to the exclusive jurisdiction of the courts of England and Wales.
